Geneva Township regular meeting, Nov. 11th, 2009. Trustees returned from Executive Session at 7:30 pm. The regular meeting was called to order by Chairman Mills at 7:32 pm. Those present were Mr. Mills, Mr. Pruden, Mr. Russell and Fiscal Officer Long. Minutes from the previous meeting were approved on a motion by Mr. Pruden, seconded by Mr. Russell with one correction. Bills in the amount of $56,182.65 covered by warrant numbers 13794-13846 were approved on a motion by Mr. Pruden, seconded by Mr. Russell. Mr. Cerjan gave the Zoning Dept. report. He indicated that he issued a permit for 4248 Padanarum Rd. where a new house is being built. He received a complaint from one property that was doing remodeling without a permit. They will get a permit after his investigation. He indicated he had still not received an answer from the Prosecutor’s Office of letters he had submitted in July and August on a number of issues. Also he indicated that after further investigation, the junk yard on Route 20, their permit has expired and will continue to investigate this situation. There was an inquiry on 3142 Padanarum Rd., a house that was repossessed by the bank. It appears to have a buyer at this time. The Road Dept. report was given by Mr. Mills. Mr. Mills indicated that ditching continues. Wheeler Creek Rd. continues to have work done including side drains and a build up of the base in anticipation of paving next Spring. The one ton truck has been painted and returned to service, the 99 truck has a new plate being designed for the bed by Schmidt Welding. We had a resident on Wheeler Creek Rd. inquire about the ditch dirt. He wanted to pay for the dirt, however Mr. Russell explained our policy, it was transferred to the nearest point where it can be disposed of and that would be at no charge. The project on S. Wheeler Creek Rd. presently under way was originally quoted at $220,000 of which $110,000 would be obtainable from the State. Presently grindings and stone base that is being put down reduced the amount of asphalt to 4 inches instead of the original 7 as set by the County Engineer. Our hope is to complete the project by July 4th, 2010. We received a letter from ODOT about resurfacing from Countyline Rd. to the City limits on State Rt. 20. This would include replacement of the bridge deck over Wheeler Creek. The detour indicated might be Wheeler Creek Rd. It was indicated by Mr. Russell we should probably send a letter to ODOT indicating that they should also video tape Padanarum Rd. since that will be used as a detour also. Chief Starkey gave the Fire Dept. report. He indicated that he is presently working on the 2010 budget. Also there has been a number of leaf fires that they had to respond to and they are going through some new employee orientation. There were some questions about the hydrants on N. Countyline Rd. The Chief will send a letter to Lake County to determine what the status is. The Chief also indicated that a lot of dollars have been put into vehicle maintenance this year. The ladder truck right now is facing a repair of up to $20,000. Mr. Russell pointed out that the new 1 mil Fire Levy in the Township was defeated by 146 votes. The Fire Committee will begin to meet again on Dec. 1st, 2009. One of the items would be a discussion on future levies that maybe forth coming. Mr. Long gave the Fiscal Officer’s report only reporting that a recent bulletin from the State Auditor indicates that the audit fees can now be spread over multiple funds. Mr. Russell presented the new modified Host Agreement with Waste Management. After a discussion, Mr. Russell made the motion, Mr. Pruden seconded. Roll call revealed: Mr. Mills – yes, Mr. Pruden – yes, Mr. Russell – yes to accept the Host Agreement. A discussion centered around the release of the Covenant. Mr. Russell made a motion to release the restricted Covenant placed on approximately 6.9 acres of real property as recorded in volume 278, page 2364 of the Ashtabula County, Ohio Records currently owned by USA Waste Management Geneva Landfill subject to the following conditions: 1.) The Township will obtain the services of an attorney of law to review and approve the documents and processes associated with the release of the Covenant prior to signing any document. 2.) The Covenant release documents must include language requiring the movement by USA Waste Management Geneva Landfill or it’s successors of all materials contained in the old Doherty Landfill to the new expansion. It was seconded by Mr. Mills. Roll call, Mr. Pruden – yes, Mr. Mills – yes, Mr. Russell – yes. Mr. Russell then made a motion to use outside Legal Counsel to review the information with a fee not to exceed $3000. It was seconded by Mr. Mills. Roll call, Mr. Russell – yes, Mr. Pruden – yes, Mr. Mills – yes. Mr. Russell indicated he is still pursuing Grant dollars to provide the sidewalk for the new School on Austin Rd. Mr. Pruden indicated that the County Trustee meeting was presented last month with some presentation in respect to the Senior Levy as well as Special Consult in Zoning. Mr. Russell indicated that he is looking at the possible combination of an Issue 1 Grant for North Avenue and N. Wheeler Creek Rd. in the next round. Beyond that, future applications would be for road paving as well as water lines. Mr. Russell asked Mr. Long to check those individuals that would be having a term expire for both the Zoning and the Zoning Board of Appeals. A member of the audience indicated that Driftwood Inn is presently open on weekends, he also indicated that the area leading to the beach had brush overgrowing and debris. He indicated that a cleanup of that area would create an entrance down to the beach, which in years past had been used. Mr. Mills reported that he had inquired with Geneva Pipeline in respect to the problem on Addison Rd. He has not received a response and he will contact them again. There being no further business, a motion was made by Mr. Pruden, seconded by Mr. Mills unanimously approved to return to Executive Session at 8:55 pm. |
